Terms of Service

This Agreement covers how you use Mellowpath (the "Service"), which includes the website at mellowpath.com, all the software and apps we offer, and everything that goes with it (together, the "Service"). USING MELLOWPATH MEANS YOU'RE AGREEING TO THIS AGREEMENT. IF YOU DON'T AGREE, PLEASE DON'T USE THE SERVICE. When you use Mellowpath, you're confirming that (a) you have the legal right to enter into this Agreement; (b) you'll follow the terms; (c) you've read and accept our Privacy Policy; and (d) your use doesn't break any laws.

You need to be 18 or older. The only exception is if you're at least 13 and have a parent or guardian's permission and supervision. If you're a parent worried about your kid using this without permission, reach out to contact@mellowpath.space. You can't use the Service if you're a competitor or if we've already banned you from it.

Mellowpath is made for personal exploration and fun. Once you download it and agree to these terms, you get a limited, personal, non-exclusive, non-transferable license to use the software the way we describe here.

You get a limited, revocable license to access and use the Service for yourself only. Don't modify, distribute, sell, or try to exploit any content without asking us first. We can update, pause, or shut down the Service whenever we want, and we don't have to give you a heads-up.

You can't: — Copy, change, or share any part of the Service — Try to figure out how it works or get at the code — Upload anything malicious or mess with our systems — Use bots, scrapers, or other automated stuff to get into the Service — Overload our servers — Break laws, invade privacy, or steal someone's intellectual property

Anything you post or send through the Service is on you. Don't submit stuff that's illegal, harmful, defamatory, or that violates someone else's rights.

Mellowpath might let you buy virtual currency or items. You have to be 18 to spend real money on them. We own everything you buy. You just get permission to use it. Virtual items stay in the Service and can't be moved elsewhere. If your account gets terminated, you lose them.

You pay for any internet, mobile carrier, or device charges that come up while you're using the Service.

The Service collects and sends information about your location, how you play, and what you access.

You might see ads from other companies based on where you are or how you use the Service. We're not responsible for what third parties do, offer, or how they handle your privacy. Anything you do with third parties is between you and them.

We include links to outside services for your convenience, but we don't endorse them or take responsibility for what's there. If you find links to third-party content, goods, services, or privacy policies, that's all on them. Whatever information you give to third parties follows their own rules.

We own all the intellectual property in Mellowpath and everything in it. You can't rent it, sublicense it, change it, reverse engineer it, or make derivative works unless we specifically say you can in this Agreement.

Any ideas or suggestions you send us aren't confidential. You're giving Mellowpath an irrevocable, non-exclusive, royalty-free, permanent license to use, modify, and share that feedback however we want.

THE SERVICE COMES AS-IS WITH NO WARRANTIES. WE DISCLAIM EVERYTHING, INCLUDING IMPLIED WARRANTIES ABOUT MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE'RE NOT LIABLE FOR LOST PROFITS OR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. IF WE CAN'T EXCLUDE LIABILITY, OUR TOTAL LIABILITY CAPS AT terms00. INDEMNIFICATION. You agree to protect Mellowpath from any claims, losses, or damages that come from (i) how you use the Service, (ii) breaking this Agreement, (iii) violating laws or someone else's rights, or (iv) stealing intellectual property.

We don't have to provide technical support unless we've agreed to it in writing separately.

California law applies to this Agreement. Any disputes get handled in San Mateo County, California. Whoever wins gets reasonable attorney's fees and court costs.

We don't say the Service is legal to use outside Canada or the United States. If you access it somewhere else, you're doing it at your own risk and you're responsible for following local laws.

You agree to follow all US export rules and not to give the Software to anyone in a prohibited country.

If we don't enforce something, that doesn't mean we're giving up the right to enforce it later. If any part of this turns out to be unenforceable, we'll replace it with something that's valid and gets as close as possible to what the original part was trying to do. Everything else stays in effect.

We can assign this Agreement or hand off our duties to someone else. You can't assign or transfer it to anyone.

We might change this Agreement, but we'll give you at least 20 days' notice by posting it on the Website. If you keep using the Service after the changes go live, you're accepting them.

This Agreement kicks in when you first use the Service and ends when you close your account. We can shut down your access whenever we want, no questions asked. Some parts of this—like the licenses, warranty disclaimers, limits on liability, and indemnification—stay around even after termination.

If you're using Mellowpath through an app store like Apple App Store or Google Play, here's what matters: — You're dealing with Mellowpath, not the app store itself — The app store doesn't have to support or maintain anything — If there's a warranty issue beyond getting a refund, that's on us — The app store isn't responsible for liability or intellectual property problems — You also need to follow the app store's own terms of service

This is the whole agreement about what it covers. It replaces anything we said before. We can only change it in writing or the way we described above.
